How
can foreigners own land/property in Mexico?
Foreigners can own land outside of the interior of Mexico via a Fidecomiso (Bank Trust).
The bank trust law (Fidecomiso) was initiated by a presidential decree in 1970 and formalized into law in 1971 allowing trusts to be established with Mexican Banks for tourist or second home markets. These trusts, now thirty three years in the making, have made possible the acquisition of a multitude of resort and coastal properties by foreign residents.
Buyers of properties in trust have all the beneficial rights of fee simple ownership allowing the buyer to reside on their property, rent their property, will their property to family members, and sell their property for handsome returns in most cases. Since the early 90’s, the life of the these trusts have evolved from 30 years to 50 years, renewable for an additional 50 years.
Is
it safe to buy real estate in Mexico?
While foreigners can not directly own land outside of interior Mexico, the use of a Fidecomiso (Bank Trust) coupled with title insurance has increased foreign purchases.
The use of title insurance from either an American title company or a Mexican title company provides safety and security of ownership.
